How long can you stay outside Poland with a temporary residence card?
Polish law does not specify a single period of absence after which a temporary residence card automatically becomes invalid. There is no general rule stating that the card loses its validity after three or six months spent abroad.
The most important factor is the purpose for which the residence permit was granted. If the card was issued on the basis of employment, studies or residence with family, the foreign national must continue to meet the conditions of that permit. Termination of employment, removal from the list of students or the cessation of another purpose of stay may result in the residence permit being withdrawn.
The competent Voivodeship Office may send correspondence to the address provided in Poland. It is therefore essential to notify the Office of any change of correspondence address and to check your post regularly.
A person holding a valid residence card and passport may travel to other Schengen countries for up to 90 days in any 180-day period. However, a Polish residence card does not grant the right to work or reside permanently in another country without obtaining the permits required under that country’s laws.
How can you check whether your residence permit remains valid?
If you have any doubts, it is advisable to contact the Voivodeship Office that granted the permit before planning a longer journey and verify whether proceedings to withdraw the permit have been initiated. The expiry date printed on the residence card does not provide a complete guarantee that the underlying residence permit has not already been withdrawn.
If the permit has been withdrawn, the residence card may no longer be used to cross the border. The foreign national may be refused entry if they have no other legal basis for entry, such as a valid visa, or if they do not meet the conditions for visa-free travel.
In summary, spending several months outside Poland does not in itself result in the automatic loss of a temporary residence card. Before travelling, however, you should verify the validity of your documents, check the status of any administrative proceedings and ensure that the purpose for which the permit was granted continues to exist.
If your employer informs the Voivodeship Office that your employment has ended and you do not take the necessary steps to regularise your situation, there is a significant risk that proceedings to withdraw your residence permit will be initiated.
Please note that every case is different and requires an individual assessment.
